1. Parties
These Terms of Service (“Terms”) are a binding agreement between Symbolic Design LLC, doing business as “webbyclick” (“we”, “us”, “webbyclick”), and you, the customer (“Customer”, “you”). By creating an account or using the service, you agree to these Terms.
2. The service
webbyclick is a hosted website-editing platform. We provision a static website for you from a template; you modify it by sending natural-language prompts through the dashboard, SMS, or WhatsApp. Changes are reviewed by automated validation, committed to versioned storage, and published to a content delivery network. Every change is reversible.
3. Eligibility
You must be at least 18 years old, or representing a business or organization, and you must be able to enter into a binding contract. You agree to use the service only for lawful purposes.
4. Your account
You are responsible for keeping your credentials secure, for everything done under your account, and for the lawfulness of the content you publish through webbyclick. Notify us immediately at halim@symbolic-design.com if you suspect unauthorized access.
5. Acceptable use
You agree not to:
- Publish content that is illegal, infringing, defamatory, deceptive, or that violates the rights of others.
- Attempt to circumvent prompt quotas, plan limits, or other usage controls.
- Use the LLM endpoints for purposes unrelated to editing your own webbyclick site (for example, as a general-purpose chatbot or for content generation unrelated to your website).
- Upload or distribute malware, phishing pages, or content that could harm users or other customers.
- Attempt to reverse-engineer, probe for vulnerabilities, or interfere with the service’s operation, except as expressly permitted by applicable law.
- Impersonate another person or business, or use the service to send unsolicited bulk messages.
We may suspend or terminate accounts that violate this section, with notice where reasonable.
6. Subscriptions and billing
Paid plans are billed in advance through Stripe, on the cycle you select (monthly or annual). Subscription fees are non-refundable except as described in Section 7. Plan tiers, prompt allotments, and prices are shown on the pricing page. We may change prices on at least 30 days’ notice; changes take effect at your next renewal.
7. Cancellations and refunds
All sales are final and subscription fees are non-refundable, except where a refund is required by applicable law. You may cancel your subscription at any time from the Stripe Customer Portal; cancellation takes effect at the end of your current billing period and you keep access until then. We may, at our discretion, issue a partial or full refund in exceptional circumstances. If a refund is issued, your editing access is paused immediately and your site may be torn down according to the timeline in Section 11.
8. AI-generated changes
webbyclick uses large language models to translate your prompts into changes on your site. AI output is generated automatically and may contain errors, omissions, or inaccuracies. We run automated validation and visual quality checks before publishing any change, but you remain responsible for reviewing your published site. Every change is reversible from the dashboard.
9. Intellectual property
You retain ownership of the content you publish through webbyclick. You grant us a worldwide, non-exclusive license to host, copy, render, transmit, and process that content only as necessary to operate the service for you.
We retain ownership of the webbyclick platform, software, template designs, and all associated intellectual property. We grant you a non-exclusive, non-transferable license to use the templates on your hosted site for as long as your subscription is active.
10. Feedback
If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use that feedback to improve the service, without any obligation to you.
11. Termination
You may delete your account at any time from the dashboard. After deletion, prompt history is removed promptly, and your site and CloudFront distribution are torn down 30 days after the request. We may suspend or terminate accounts that violate these Terms, that remain unpaid, or where required by law, with notice where reasonable.
12. Disclaimer of warranties
The service is provided “as is” and “as available”, without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI output will meet your expectations.
13. Limitation of liability
To the maximum extent permitted by law, Symbolic Design LLC and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve months preceding the claim.
14. Indemnification
You will defend and indemnify Symbolic Design LLC against claims arising from your content, your use of the service in violation of these Terms, or your violation of applicable law.
15. Governing law
These Terms are governed by the laws of the United States and the state in which Symbolic Design LLC is organized, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Dispute resolution
Before filing any claim, you agree to attempt to resolve the dispute informally by emailing halim@symbolic-design.com. If the dispute is not resolved within 30 days, it will be brought in the state or federal courts having jurisdiction over Symbolic Design LLC’s principal place of business, and you consent to that jurisdiction.
17. Changes
We will notify active customers by email at least 30 days before material changes to these Terms take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
18. Miscellaneous
These Terms, together with our Privacy Policy, Cookie Policy, and (where applicable) Data Processing Addendum, are the entire agreement between us. If any provision is held unenforceable, the remainder remains in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our written consent.
